TO WHOM IT MAY CONCERN: Below are current public notices of permit applications, notice of individual permit decisions, announcement of public hearings or meetings, and/or rule-making activities. Public comment and participation are encouraged on all of these issues.
The applications described below have been submitted for Aquatic Resource Alteration Permits under The Tennessee Water Quality Control Act of 1977, T.C.A. §69-3-108. In addition, a federal permit may be required from the U. S. Army Corps of Engineers or from the Tennessee Valley Authority under §404 of the Clean Water Act and §26a of the Tennessee Valley Authority Act , respectively. Section 401 of the Clean Water Act requires that an applicant must obtain a water quality certification from the state when a federal permit is required. These notices may cover applications subject to §401 or navigation permitting (Rule 1200-04-08).
No decision has been made whether to issue or deny these permits. The
purpose of these notices is to inform interested parties of this permit
application and to ask for comments and information necessary to determine
possible impact to water quality. Persons wishing to comment on a proposal
are invited to submit written comments to the department. Written comments
must be received within thirty days of the date that the notice is posted.
Comments will become part of the record and will be considered in the
final decision. The applicant’s name and permit number should be
referenced.
The permit application, supporting documentation including detailed plans
and maps, and related comments are available for review and/or copying
at the department’s Natural Resources Section.
Interested persons may also request in writing that the department hold a public hearing on an application. The request must be filed within the comment period, indicate the interest of the person requesting it, the reasons that the hearing is warranted, and the water quality issues being raised. When there is sufficient public interest in water quality issues, the department shall hold a public hearing in accordance with Rule 1200-4-7-.04(4)(f).
In deciding whether to issue or deny a permit, the department will consider all comments of record and the requirements of applicable federal and state laws. In making this decision, a determination will be made regarding the potential lost value of the resource compared to the value of any proposed mitigation. The department shall consider practicable alternatives to the alteration. The department shall also consider loss of waters or habitat, diminishment in biological diversity, cumulative or secondary impacts to the water resource, and adverse impact to unique, high quality, or impaired waters.

NRS07.176 Stillwater Development proposes to constrict a 495 single family development surrounded by an 18-hole golf course that will require the relocation of 2200 linear feet of stream, one crossing over Nelson Creek, two crossings over unnamed tributaries and several; golf cart crossings; College Grove, Williamson County.
NRS07.288 Tennessee Wildlife Resources Agency was issued an emergency permit to repair boat ramps on Reelfoot Lake due to extreme low water levels, Lake and Obion Counties.

NRS06.122 City of Portland, The division has determined that the City of Portland has failed to sufficiently justify their proposal to degrade Caney Fork Creek, a high quality stream. This is a determination under the “Antidegradation Policy” rather than a permit decision.
NRS06.132 TDOT proposes to improve a 4.587-mile segment of SR 99 from US 41A(SR 6) near Eagleville to the new construction west of SR 269 (Concord Road). Impacted will be 9 streams; Kelley Creek, 3 unnamed tributaries to the Harpeth River, Puckett Branch, 1 unnamed tributary to Puckett Branch, 3 unnamed tributaries to Concord Creek and 5.87 acres of wetland including 4.226 acres of permanent fill and 1.64 acres temporary disturbance. PH2007-024 A public hearing will be held by the Tennessee Division of Water Pollution Control regarding the proposal by TDOT to widen a 2.608 mile segment of I-75 from 1.1 miles north of US11 to 1.2 miles south of US 11 in Hamilton County. Impacts will occur to 5 streams and one wetland. Date: Friday, August 31, 2007 Time: 2:00pm Eastern Location: Chattanooga Environmental Field Office, Chattanooga, TN.
NRS05.457 TDOT proposes to widen a 3.803-mile segment of the existing US 64(SR-15) from West of SR 99 to Old Highway 64. Ten streams and two springs will be impacted by this road project. Barlow Branch, unnamed tributaries to Hurricane Creek, Furnace Branch and unnamed tributaries to Furnace Branch, Wayne County.
NRS 06.282 TDOT proposes to widen and construct a new segment of SR 15 in Hardeman and McNairy Counties. Due to the project a total of 22 streams and 5 wetlands would be altered. NRS07.091 TDOT proposes to widen a 2.608 mile segment of I-75 from 1.1 miles north of US11 to 1.2 miles south of US 11. Impacts will occur to 5 streams and one wetland. PH2007-008 The Division will hold a public hearing concerning the division’s intent to issue its written consent to Waste Management, Inc. of Tennessee allowing the modification of a Declaration of Restrictions that was previously granted to protect 20.6 acres of wetlands created as mitigation for impacts to waters of the state that were permitted under ARAP No. NRS 93-704. §401 Water Quality Certification No. NRS 03-246 was issued to Waste Management, Inc. of Tennessee permitting activities that will impact 1.25 acres of jurisdictional wetlands (part of the 20.6 acres of wetlands created as mitigation under ARAP No. NRS 93-704) and result in the relocation of 2,242 linear feet of an unnamed tributary to the Cumberland River. NRS07.043 TDOT, proposes to realign the bridge and approaches over Nelson Creek, required is a stream crossing of Nelson Creek and two unnamed tributaries, Lauderdale County
NRS07.056 US Army Corps of Engineers proposes to perform maintenance dredging for navigation depth on Hiwassee River miles 11.5-13.0 and 16.5-17.5. McMinn and Bradley Counties.
NRS07.071 TVA proposes to construct a gypsum disposal facility on a peninsula at the Kingston Fossil Plant that will require the placement of fill in 4.81 acres of jurisdictional wetlands. A Public Hearing is jointly being noticed with this application. Roane County.
NRS07.072 Tennessee Gas Pipeline Company proposes to replace 880 feet of gas pipeline that will require the temporary impact to 1.10 acres of wetland and one crossing of Rose Creek. McNairy County
